Release and Agreement of Use

In consideration for being allowed to participate in the curriculum that will provide information, instruction, and technique on motorcycle riding (the “Activity”) supplied by Ride-Right Motorcycle Training LLC, a New Hampshire limited liability company (the “Company”) and in recognition of the Company’s reliance thereon, I, the individual named below (referred to as “I” or “me”) agree to all the terms and conditions outlined in this instrument (this “Release”).

WARNING

MOTORCYCLE RIDING AND ALL ASSOCIATED AND RELATED ACTIVITIES ARE DANGEROUS, AND THERE ARE RISKS INVOLVED IN YOUR PARTICIPATION, INCLUDING SERIOUS INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE. THE UNFORESEEN MAY HAPPEN, AND NO ONE MAY DELINEATE ALL RISKS OR POSSIBILITIES OF ERROR. WHILE THE TECHNIQUES AND MINDSETS PRESENTED IN THIS CURRICULUM HAVE BEEN DEVELOPED TO KEEP YOU SAFE AND HEALTHY, I ACKNOWLEDGE THAT ANY INJURIES THAT I SUSTAIN MAY RESULT FROM OR BE COMPOUNDED BY THE ACTIONS, OMISSIONS, OR NEGLIGENCE OF THE COMPANY. NOTWITHSTANDING THE RISK, I ACKNOWLEDGE THAT I AM VOLUNTARILY PARTICIPATING IN THE ACTIVITY AND IN MOTORCYCLE RIDING WITH KNOWLEDGE OF THE DANGER INVOLVED AND HEREBY AGREE TO ACCEPT AND ASSUME ANY AND ALL RISKS OF INJURY, DISABILITY, DEATH, AND/OR PROPERTY DAMAGE ARISING FROM AND AFTER MY PARTICIPATION IN THE ACTIVITY, WHETHER CAUSED BY THE ORDINARY NEGLIGENCE OF THE COMPANY OR OTHERWISE.

IF YOU ARE NOT ABLE TO FOLLOW THE INSTRUCTIONS PROVIDED IN THE CURRICULUM, YOU SHOULD NOT TAKE PART IN THE ACTIVITY OR IN MOTORCYCLE RIDING IN GENERAL. OTHERWISE, PLEASE CONTINUE TO READ THE INFORMATION PROVIDED SO THAT YOU UNDERSTAND THAT WE ARE NOT LIABLE FOR ANY INJURY OR DAMAGE YOU CAUSE TO YOURSELF, TO OTHERS, OR TO ANY PROPERTY OR EQUIPMENT YOU OR OTHERS OWN, BORROW OR RENT AS YOU TAKE PART IN THE ACTIVITY.

The lessons presented in the RRMT curriculum are demonstrated by professional riders.

I hereby expressly waive and release any and all claims, now known or hereafter known, against the Company, and its officers, directors, manager(s), employees, agents, volunteers, instructors, contractors, affiliates, members, owners, successors, and assigns (collectively, “Releasees”), on account of injury, disability, death, or property damage arising out of or attributable to my participation in the Activity, whether arising out of the ordinary negligence of the Company or any Releasees or otherwise. I covenant not to make or bring any such claim against the Company or any other Releasee and forever release and discharge the Company and all other Releasees from liability under such claims.

I shall defend, indemnify, and hold harmless the Company and all other Releasees against any and all losses, damages, liabilities, deficiencies, claims, actions, judgments, settlements, interest, awards, penalties, fines, costs, or expenses of whatever kind, including attorney fees, fees, the costs of enforcing any right to indemnification under this Release, and the cost of pursuing any insurance providers, incurred by the Company or any other Releasees in a final judgment, arising out or resulting from any claim of a third party related to my participation in the Activity, including any claim related to my own negligence or the ordinary negligence of the Company.

I understand and agree that I am solely responsible for all costs related to any medical treatment and any related medical transportation and/or evacuation in the event I am injured or require medical attention as a result of my participation in the Activity. I hereby release, forever discharge, and hold harmless the Company from any claim based on such treatment or other medical services.
I am over the age of eighteen or have a parent or guardian’s permission to access this information and website.

This Release constitutes the sole and entire agreement of the Company and me with respect to the subject matter contained herein and supersedes all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, concerning the such subject matter. If any term or provision of this Release is invalid, illegal, or unenforceable in any jurisdiction, such invalidity, illegality, or unenforceability shall not affect any other term or provision of this Release or invalidate or render unenforceable, such term or provision in any other jurisdiction. This Release is binding on and shall inure to the benefit of the Company and me and their respective successors and assigns. All matters arising out of or relating to this Release shall be governed by and construed in accordance with the internal laws of the State of New Hampshire without giving effect to any choice or conflict of law provision or rule (whether of the State of New Hampshire or any other jurisdiction). Any claim or cause of action arising under this Release may be brought only in the federal and state courts located in Merrimack County, State of New Hampshire and I hereby consent to the exclusive jurisdiction of such courts.

COPYRIGHT AND INTELLECTUAL PROPERTY NOTICE

RRMT lectures and course materials, including presentations, videos, quizzes, drills, and similar materials, are protected by copyright, Title 17, U.S. Code. Ride-Right Motorcycle Training, LLC., is the exclusive owner of the copyright in those materials contained in the RRMT curriculum. Ride-Right encourages you to take notes for your own educational use. However, you may not, nor may you knowingly allow others to reproduce or distribute course materials without express written consent.

This includes providing materials to commercial courses material suppliers and other similar services.

Users who distribute or display or help others distribute or display copies or modified copies of course materials will be prosecuted to the fullest extent possible.

Electronic video and/or audio recording of any portion of RRMT is not permitted without explicit written permission. If such permission is granted, any distribution of the recording is prohibited without further explicit written permission.
